MyLife - TERMS OF USE (Contract)

Version:  January 2024

Please read these Terms of Use carefully, particularly paragraphs 12-16 inclusive which contain important provisions which limit our liability to you.

These terms of use (as amended from time to time, the “Terms”) govern users’ (“you” or “your”) downloading, access to and use of the MyLife mobile app and website and services available on them (“MyLife”).

You can only access, download and use MyLife if you are aged 18 or older, live in the Republic of Ireland and are legally permitted to enter into binding agreements.

Your access to, downloading and use of MyLife is subject to your acceptance of and compliance with these Terms and, where you download the MyLife app, the App Store rules referred to in paragraphs 18 and 19. Each time you download, access or use MyLife (including any updates), you agree to the then current version of these Terms and, if applicable, relevant App Store rules. If you do not agree to the current version of these Terms or, if applicable, App Store rules, you are not permitted to continue accessing or using MyLife and must remove the MyLife app from your device.

You may download, access and use MyLife solely for your personal and non-commercial use.  This is the only right and licence granted to you under these Terms.

These Terms are separate to our Privacy Notice and Cookies Notice. You should read them carefully.

You must own or control the devices you use in order to download and use the MyLife app.  You are responsible for installing MyLife app updates.  If you don’t do so, this may impact MyLife functionality and security and your ability to use it.

MyLife provides you with a Health Score and various health, wellbeing and similar information, advice and/or coaching (collectively the “MyLife Information”) compiled based on the details specified by you or which you instruct wearable device operators or mobile app providers to provide to us, such as certain health data, family history, activity data and information about your lifestyle (the “Data”).

When you create an account on MyLife, we check if you currently hold a policy with us or our affiliates (though you currently do not have to have a policy to be able to use MyLife).  We will continue to check this on a regular basis and for the duration of your account. This impacts upon the membership tier assigned to your account.

We can monitor your use of MyLife and access, read, preserve and disclose any MyLife Information or your Data or Content to the extent we believe this is necessary to:

  • satisfy any applicable law, regulation, legal process or governmental request;

To register, with your consent we will use your Data to:

  • Calculate your Health Score – the MyLife app will use your Data to calculate and refresh your personal Health Score. It will also use this Data to earn you MyLife Points and enable you to participate in Challenges. Accounts created to replace suspended or terminated accounts will be permanently suspended or terminated.

We assess possible risks for users regarding use of any features of MyLife that enable interaction between users and decide in each case whether it is appropriate to use moderation of the relevant service (including what kind of moderation to use) in light of those risks. However, we are under no obligation to oversee, monitor or moderate any interactive service we provide on MyLife, whether the service is moderated or not.

Irish Life reserves the right to take the following actions in particular for failure to comply with the Acceptable Usage Policy or these Terms:

We do not acquire any ownership rights in respect of your Data or Content, but you do grant us a perpetual worldwide licence to use, distribute, store, analyse, aggregate, de-personalise and adapt your Data and Content – this licence continues after you or we terminate your account. However, this does not limit or affect your rights under the General Data Protection Regulation.

All copyright, database right, trademarks, patent, other intellectual property right, title and interest in and to MyLife and any MyLife Information (excluding your Data and Content) are and will remain the exclusive property of Irish Life or its licensors. The elements of MyLife (including but not limited to the general design and the imagery and any MyLife Information) are protected by copyright, database right, trademark, patent and other laws relating to intellectual property rights. Nothing in these Terms gives you a right to use the Irish Life name or the name of any of Irish Life group companies or Irish Life’s or its licensers’ trademarks, logos, domain names and other distinctive brand features. You are permitted to download and print any MyLife Information from MyLife solely for your own personal use. You are not entitled to use the content of MyLife for commercial exploitation in any circumstances.

MyLife contains links to third-party websites and apps (including the Rewards Store described below). Irish Life does not accept any responsibility or liability for:

  • the availability or accuracy of such third party apps or websites;
  • the content, products, materials, or services on or available from such third party apps or websites.

Links to such third party apps or websites do not imply any endorsement by Irish Life of such apps or websites or the content, products, services or materials on or available from such third party apps and websites. You are solely responsible for, and assume all risks arising from, your use of any such apps and websites and any purchases you make through them.

We apply membership tiers for MyLife based on whether users are our or our affiliates’ customers and the type of policy they have with us or our affiliates. The membership tiers give users the opportunity to unlock features and benefits of MyLife. There are currently three membership tiers in MyLife with different features and benefits:

Standard Membership

Enhanced Membership

Premium Membership

Who is eligible

Non-customers of the Irish Life group

Determined by the products held by Irish Life customers

*Reward Store

No (promotional prize only)

Yes - restricted

MyLife Points accumulation

*MyLife Points redeemable

*The Rewards Store contains a wide selection of products and experiences provided by various partnering merchants, along with other discounts, branded merchandise, other events and prizes.  Only users with a Premium Membership may access and avail of the full suite of rewards contained on the Reward Store.  Users with Enhanced Memberships have restricted access to only certain types of rewards as determined by MyLife from time to time.

We may change the membership tiers (including by introducing new ones or removing existing ones) and the eligibility criteria, features and benefits for the different membership tiers at any time, at our sole discretion.

You will be allocated a membership tier based upon your circumstances when you first register for MyLife. If you subsequently meet the eligibility criteria for a higher membership tier, we will upgrade you to the higher membership tier automatically.  Similarly, if you cease to meet the eligibility criteria for a particular membership tier, we will normally move you to a lower membership tier automatically.

MyLife gives all users the opportunity to earn and accumulate points (“MyLife Points”) based on their activity level and the Data and Content that they provide to us.

You can redeem and use your MyLife Points in the Reward Store based upon your current membership rights (see paragraph 10) but only if you have an Enhanced Membership or a Premium Membership and only whilst your membership is current. If your MyLife Account is inactive for more than twenty four months, your MyLife Account will be deactivated and your My Life Points suspended. You will be able to reactivate your account within 30 days of deactivation by contacting the Customer Support Team. After 30 days your account will be permanently deleted and your MyLife points will no longer be usable.

The “Rewards Store” is currently operated by Loylogic Inc (and its affiliates) and for Enhanced and Premium membership this can be accessed through the MyLife app.

The MyLife Points are only redeemable and usable in the Reward Store. In order to do so, you must agree to the terms of the operator of the Reward Store. The Reward Store is operated by a third party provider and we are not responsible or liable for anything done or not done by the Reward Store or operator of the Rewards Store. You are responsible for reading the terms and conditions of the Reward Store and any other information made available to you through it to understand your rights and responsibilities in such regard.

We can change the Reward Store to a rewards store operated by a different third party by notice on MyLife. In that case, your MyLife Points on the old Reward Store will be cancelled and will cease to be redeemable in the old Reward Store but we will make provision for equivalent MyLife Points to be available to you in the replacement Reward Store.

MyLife Points may only be accrued by you on your own behalf, and not by or on behalf of any third party. MyLife Points at all times remain the property of Irish Life and have no cash value or other value, except to allow Enhanced Members and Premium Members to redeem them in the Rewards Store. You may not sell, purchase or transfer MyLife Points or your MyLife account, except as expressly permitted by us in writing.
MyLife Points are not transferrable (i) upon death; (ii) as part of a domestic relations matter; or (iii) in any other circumstances without the express written permission of Irish Life. Any violation of these rules may result in account termination and/or cancellation of accrued MyLife Points.

You are responsible for ensuring that MyLife Points have been properly credited to you. We reserve the right to audit your account without notice for compliance with these Terms. In the event an audit reveals discrepancies or possible violations, your account may be suspended, and the operator of the Reward Store may be notified pending completion of the audit.
MyLife Points are automatically forfeited in MyLife accounts that are terminated or cancelled for any reason and you are not entitled to any reimbursement or compensation in connection with any such forfeiture.
We may reduce your MyLife Points total in certain circumstances based on your actions. For instance, if, in our opinion, you are not complying with these Terms or your behaviour is affecting in any way the proper running of MyLife and/or the rewards programme.

As mentioned above, you can only redeem and use your MyLife Points in the Reward Store if you have a Premium Membership or, with more restricted benefits, an Enhanced Membership, and only whilst your membership is current.

When you buy something through the Reward Store, you can pay with MyLife Points or a combination of your MyLife Points and money using a debit or credit card. The Reward Store will list the amount of MyLife Points/cash required to purchase an item. Only MyLife Points accrued and credited to your MyLife account at a given time are available to use in the Reward Store. When you use MyLife Points to redeem a reward in the Reward Store, your MyLife Points wallet will be reduced by the number of points used to acquire the reward. If your reward order is cancelled due to an issue with redeeming a reward (such as the reward becoming unavailable), Irish Life will reinstate your MyLife Points.

Your use of the Rewards Store and your relationship with the operator of the Reward Store or any merchants who trade on the Reward Store is governed solely by your agreements with that operator or merchant. When you make purchases on or through the Rewards Store, you may enter into a transaction and contract with the relevant merchant on its terms and conditions. Irish Life never becomes a party to any transactions you enter into on the Reward Store. MyLife only provides you with access to the Rewards Store, and through its relationship with the operator of the Reward Store, allows you to use MyLife Points which you accrued on MyLife in the Reward Store.  We are not responsible for, and do not have any liability for, anything you buy on or through the Rewards Store.

MyLife allows you to register for the participation in fitness activity challenges among certain or all users of MyLife. These challenges may be initiated by Irish Life (“MyLife Challenges”), or by other organisations who have partnered with us to initiate challenges (“Corporate Challenges”). If you participate in a challenge, you do so in the knowledge that participating in them is a potentially hazardous activity and that you are participating at your sole risk and responsibility.

Participation in a MyLife Challenge or Corporate Challenges may be subject to additional terms and conditions. Where this is the case, we will make the terms and conditions available at the point of entry and participation in the MyLife Challenge or Corporate Challenge, as applicable, will be subject to your agreement to those terms and conditions.

We are not responsible for Corporate Challenges and do not actively monitor them for safety or other reasons. Without limiting or affecting this, we have the right to require that our partners terminate, stop or suspend Corporate Challenges or participation by users in them at our sole discretion.

You agree not to make use of means or behave in a way that can reasonably be considered as contrary to the general rules of fairness in connection with any challenges.
We have the right to screen and verify your activity and to temporarily or permanently exclude you from any or all MyLife Challenges or Corporate Challenges or to suspend or terminate your account if we reasonably believe that such measure is necessary to:

  • satisfy any applicable law, regulation, legal process or governmental request;
  • enforce these Terms or any other terms and conditions applicable to the relevant challenge, including the investigation of a potential violation of them; or
  • to protect the rights, property or safety of Irish Life, its affiliates, users and the public.

MyLife Challenges may feature prizes, such as Reward Points, entry  into raffles, or other gifts. Such prizes will be issued to the users achieving the best result as determined in accordance with the published rules of the MyLife Challenge. The assessment of what is the best result is separately defined for each MyLife Challenge based upon the relevant published rules. If there is a tie between the achievements of two or more users, the prizes will be equally shared between such users (unless the published rules say otherwise).   Only users who participate fairly in MyLife Challenges according to its rules and spirit may be judged as having achieved the best result and will be issued with a prize. Cheating is strictly prohibited, which includes any attempt to hack the MyLife app with a view to manipulating challenge results. Penalties and sanctions will be issued to any participants found to have cheated which may include cancellation of their MyLife account, reduction of their MyLife Points and other sanctions we deem appropriate taking into account the violation and any harm caused.

Any decisions of Irish Life regarding MyLife Challenges or Corporate Challenges are final.

See paragraph 15 below for details of our liability to you in respect of any challenges you participate in.
